INTRODUCTION

These terms of use refer to the website sigma.com.mt (“the site” or “our site”). Any access or registration pertaining to the site qualifies as full use, and is subject to the terms listed below.

Please examine these terms prior to use. Use of our site confirms that all the terms and conditions listed below have been accepted by the user.

DEFINITIONS

A “service” is the vacancy listing or promotion being carried out through the site.

The “Privacy Policy” governs all privacy issues related to the site, including our cookie policy.

 “We”, “us”, “our” “SiGMA” and the “Company” refer to: VikingPCHealth [add company info + registration details]

“Website”, “the site” or “our site” refer to www.sigma.com.mt 

CHANGES TO THESE TERMS

We may revise these terms of use at any time by amending this page, and any such changes will take effect on the lapse of the 30th day after such changes are made and notified to you by way of electronic or other written communication.

Please check this page from time to time to take notice of any changes we made, as they are binding on you.

CHANGES TO OUR WEBSITE

We reserve the right to update any and all content on the site as necessary, and strive to ensure that all content and information therein is relevant and up to date. However, any content visible on the site, including items supplied by third parties, may be up to date at any time. We do not assume responsibility for any errors or omissions therein, and assume no obligations related to these inaccuracies.

ACCESSING OUR WEBSITE

Access to the site is free, but we cannot be held liable for any interruptions in service, in whole or in part. These interruptions may be scheduled maintenance/upgrades – but may also include unscheduled downtime. Access to the site may be restricted, discontinued or monetised, in whole or in part, at any time with no advance notice. We do not assume any liability for any unavailability related to the site. The use is responsible for material arrangements required for access to the site.

THE CLIENT

The Client hereby undertakes and warrants:

That any contact made with any Job Seeker through our site or associated services will occur solely for recruitment in good faith;

That any information supplied in association with the Service is accurate and complete to the best of the Client’s knowledge; and

To indemnify us against all claims made by third parties in respect of the misuse of the data supplied to or by the Client.

THE JOB SEEKER

The information displayed or transposed on our site is largely provided by third party sources that are not affiliated with us directly. It is the Job Seeker’s responsibility to perform any necessary due diligence on the third parties themselves, the suitability of the information supplied, and any assessment on the job listing specifically, even in cases where this was made available through indirect links or advertisement. We cannot guarantee that any applications will see fruition.

One mail-shot will be sent per job vacancy on our Clients’ behalf. Personal and contact information is collected solely for legitimate use, as it pertains to the requirements of the Service being provided.

The Job Seeker can unsubscribe at any time. Links to that effect are included in our communications. Any registration details you use must be personal to you and must not be used by anyone else. We accept no liability for any breaches, whether through negligence or malicious/criminal intent. We do not guarantee compatibility with your email, and are under no obligation to take measures to that end.

THE SERVICE

The Client agrees to provide us with all necessary materials required for the provision of the service in the correct format. We are under no obligation to provide the service until the information, design work, artwork and logos necessary are duly supplied.

Such information shall be supplied within three days of formal agreement with the client.

All advertising and communications will only be published or issued with the Client’s approval.

The Client may remove an Advertisement from the Site before the Advertisement has reached its expiry date but shall not be entitled to a refund for the time not used.

We reserve the absolute right, to decline, cancel or remove any Advertisement for any reason and at any time without prior notice.

We will endeavour to publish the Advertisement or provide the Service on the agreed date. We do not accept liability for any consequences, howsoever arising, due to error or delay in provision of the Services and has the right at its sole discretion to decline to publish or omit, suspend or change the position of any Advertisement accepted by it.

We may at our discretion and without prior notice, report any Advertisement or Service used, which in its reasonable opinion is being used for an improper or illegal purpose by a Client, to the relevant authorities.

We shall be entitled at any time to make changes to the Service, which are necessary to comply with any applicable security or other statutory requirements and shall determine the manner in which the Service is provided.

REGISTRATION

Registration may be completed through our online portal. Access must not be given to third parties. This applies to both Clients and Job Seekers.

Any unauthorised use of SiGMA accounts must be signalled immediately. Use of account privileges may be shared, though express consent by the person in whose name the account was opened is required.

Accounts may be suspended or closed at any time.

INTELLECTUAL PROPERTY RIGHTS

SiGMA retains all rights on all native content. Intellectual property belonging to third parties is used legitimately on the site without prejudice to the rights of the owner or originator, which are still enforceable to their full extent.

LIMITATION OF LIABILITY

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our site; or
  • use of or reliance on any content displayed on our site.

You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

The company will not be liable for any harmful material that may infect users’ systems or similar damage to users’ property via direct use of the site, downloads from the site, or links to third parties made via the site. The company is not required to monitor content on websites linked on our site, nor does it assume responsibility for it. Links to third parties do not constitute endorsement or solicitation.

 VIRUSES

We shall endeavour to fully secure our site from viruses and all other malicious material. However, we accept no liability for any propagation of such material that occurs via our site. Users are still responsible for securing their own systems.

Any knowing misuse of our site, including malicious attacks and unauthorised access may be prosecuted to the full extent of the law.

ACCEPTABLE USE

Restricted activity includes:

  1. Any use of the site that negatively impacts its performance;
  2. Any use of the site that constitutes or promotes fraud or any other form of crime;
  3. Any systematic or automated data collection activity without express written consent;
  4. access or otherwise interact with our website using any robot, spider or other automated means;
  5. Any direct marketing activity – including without limitation email marketing, SMS marketing, telemarketing and direct mailing – that utilises data collected from our site.

Clients and Job Seekers must ensure that all the information supplied to us through our website, or in relation to our website, is true, accurate, current, and complete to the best of their knowledge.

LINKING TO OUR WEBSITE

Users may link to our site within the constraints of the law. These links do not necessarily imply endorsement. We reserve the right to withdraw linking permission without notice.

THIRD PARTY LINKS AND RESOURCES IN OUR SITE

Third party links are of purely informational nature. It does not constitute advice or solicitation of any kind. We do not take responsibility for the contents and accuracy of those sites or resources.

GENERAL

The Client accepts that we cannot guarantee the number of recipients or the responses to the mailshot or any Advertisement, without prejudice to any privacy requirements under law.

We are not party to any communications that occur as a result of our listings, advertisements or communications, and do not assume any associated liability.

APPLICABLE LAW

These terms of use are governed by the laws of Malta. The user hereby consents to the exclusive jurisdiction and venue of courts in Malta in all disputes arising out of or relating to the use of the website. Use of the website is unauthorised in any jurisdiction that does not give effect to all provisions of these terms and conditions.
